Terms & Conditions

1. Condition of Sale:

All sales are subject to CooperOwen Ltd’s terms and conditions of business available to view in this catalogue and on our website CooperOwen

1a Except as otherwise stated CooperOwen Ltd. acts as agent for the seller. The contract for the sale of the property is therefore made between seller and the buyer.

1b All consignments are on a no time limit restraint basis and will be promoted until sold or withdrawn which will be at a 20% rate of value charge of item or collection to withdraw subject to agreement and release from CooperOwen.

2. Value Added Tax:

The following symbols are used to denote that VAT is due on the Hammer Price and Buyer's Premium:

† - VAT at 17.5% on the Hammer Price and Buyer's Premium

* - VAT at 5% on Hammer Price but VAT at 17.5% will be added to the Buyer's Premium which will be invoiced on a VAT inclusive basis except where the following symbol is used.

‡ - VAT payable on premium only (lot held outside of the EC, VAT is not refundable, import taxes may apply)

3. Buyer's Premium:

A premium of 17.5% (plus applicable rate of VAT) is payable on the Hammer Price.

CooperOwen Ltd reserves the right to charge interest on all accounts outstanding over five days, together with storage and removal charges where applicable.

4. Saleroom Notices

Please check any saleroom or online notices as these supersede catalogue descriptions.

5. Starting Times and Bidding:

Please check the sale starting time and any withdrawals as these will affect the time your lot comes up. Auction speeds can often exceed 100 lots an hour. Bidding is generally in increments of 10%.

6. Payments New Buyers:

Please contact CooperOwen Ltd’s Accounts Department either by phone on +44 (0) 791 993 4115 or e mail louise@cooperowen.com before the sale to make arrangements for payment prior to the auction. This will avoid delays as cheques must be cleared before purchases are released. There is a small surcharge on various methods of payments, this is to cover bank charges.

The following forms of payment are accepted by CooperOwen:

Sterling Cheque: All cheques must be cleared before you can collect your purchases. A valid cheque guarantee card must support all cheques.

Bankers Draft or Building Society Cheque: These will enable you to collect your purchases immediately (assuming they are lots in the possession of CooperOwen Ltd) accompanied by suitable proof of identity. Please note there is a 1% surcharge taking this payment.

Cash: We are happy to accept cash but advance warning for larger amounts is appreciated.

Bank Transfer: CooperOwen Ltd’s Bank details are available on request. When making transfers please give invoice number as a reference. Please note that there is a 1% surcharge for using this method.

Debit Cards: We accept Switch and Delta cards. If you have another card please contact us and we can confirm if we can accept it.

Credit Cards: Visa, Access, Mastercard. Please note there is a 2% surcharge on the total of your invoice for using this facility.

7. Collection by Agents

If an agent or carrier is collecting on behalf of a buyer and cannot produce the correct paperwork including written authority from the buyer then CooperOwen Ltd cannot release the property.

8. Collection and Storage Charges

Most purchases can be cleared on the day after the sale (assuming payment is accepted in full), depending on the specific venue of the auction or up to one week after the sale from our offices (Please contact us in the first instance for our address). Please note some lots will not be located at CooperOwen Ltd’s office. We do suggest you telephone prior to arranging collection. If lots are not collected at this stage a charge will be applied.

9. Damage, Repair and Restoration

However, prospective Buyers are reminded that each lot is sold as is. Lots sold as collector's items are such that CooperOwen Ltd cannot guarantee them in working order.

Buyers are reminded that all statements made and contained in this catalogue and on CooperOwen Ltd’s website, CooperOwen, advertising or otherwise are statements or representations of fact.

10. Shipping

CooperOwen Ltd will be happy to recommend reputable shipping agents. All shipping is at the buyer’s expense.

11. Frames and Glazing:

CooperOwen Ltd is not liable for damage to frames or glazing. CooperOwen Ltd maintains the option to remove all glazing for the purpose of shipping.

12. CooperOwen has exclusive right to sell all unsold lots on reserve within 28 days of the sale date.

13. Right to refuse Consignment:

CooperOwen reserves the right to refuse any consignment at CooperOwen’s sole discretion whereby it is deemed, at our absolute discretion, to be necessary. CooperOwen nor any of its affiliates, employees or other representatives shall not be liable or accept any responsibility whatsoever to any persons for any losses incurred as a result of a refusal.
